6 Your right to withdraw
Consumers may withdraw from a distance purchase without giving a reason within 14 calendar days after the day on which they, or a designated person other than the carrier, receive the goods. For several goods ordered together and delivered separately, the period runs from receipt of the last item. You may also withdraw before delivery. More favourable mandatory rules remain applicable.
This right covers standard limited edition prints and existing original artworks bought at a distance. Printing a standard catalogue design only after an order, signing it, numbering it, or allowing a choice of standard paper size does not by itself make the item personalised or remove this right.
An exception can apply to a genuinely bespoke work made to your individual specifications, such as an expressly commissioned personalised work, where the statutory conditions are met and the exception was clearly explained before purchase. The limited nature of an edition alone is not such an exception.
To withdraw, send a clear statement to support@ingriddorcak.art or to Know-how, n.o., Hviezdoslavova 7, 080 01 Prešov, Slovakia. The model form attached to these terms is optional. Sending the notice within the applicable period is sufficient; prior approval from the seller is not required.
You may also use the “Withdraw from contract here” function accessible in the website footer and in Customer Care. It lets you identify yourself and the order, specify the address for confirmation, review the notice and submit it using “Confirm withdrawal”. We confirm the notice and its submission date and time without undue delay by email or another durable medium you indicated. This online option does not replace the email or postal option.
7 Returning goods and refunds
After notifying us of withdrawal, send the goods back without undue delay, no later than 14 calendar days after the notice, unless we agree to collect them. Return them to Know-how, n.o., Hviezdoslavova 7, 080 01 Prešov, Slovakia. Including your order number helps identify the return.
You bear the direct return shipping cost for a change-of-mind return. We recommend tracked, appropriately insured transport and protective packaging, especially for originals. Original packaging is recommended but is not a condition of withdrawal. For goods that cannot normally be returned by post, the return cost or a reasonable estimate will be disclosed before purchase. Please do not use cash-on-delivery returns without agreement.
You may inspect the goods as reasonably necessary to establish their nature, characteristics and functioning. You are responsible only for diminished value caused by handling beyond that level, under the applicable legal conditions. Please include the supplied certificate and documentation. Missing documentation does not automatically remove the withdrawal right; any lawful reduction must reflect actual diminished value.
We refund payments received for the withdrawn goods, including the cost of the least expensive standard delivery we offered, within 14 calendar days of receiving the withdrawal notice. We need not refund the extra cost of a premium delivery service you selected. If standard outbound shipping was free, we will not retrospectively deduct an outbound shipping charge.
Unless we offered to collect the goods, we may withhold the refund until we receive the returned goods or evidence that you sent them back, whichever occurs first. We use the original payment method unless you expressly agree otherwise, without a refund fee.
A returned print retains its edition number. It may be sold again as the same physical copy only after its condition and documentation are checked. A refund does not automatically create an additional edition copy.
8 Defects and complaints
For consumer sales governed by Slovak law, we are liable for a defect that existed at delivery and becomes apparent within two years after delivery. A defect appearing during that period is presumed to have existed at delivery unless proved otherwise or incompatible with the nature of the goods or defect. Applicable more favourable mandatory rights remain unaffected.
Please notify a defect within two months of discovering it and within the applicable liability period. You may notify it by email, post or another legally permitted method. Include the order and artwork details, a description and photographs if available. Photographs, original packaging and notification within 48 hours are not conditions for statutory rights.
We provide written acknowledgement without undue delay, with the time needed to remedy the defect. Repair or replacement is free of charge, at our expense, without significant inconvenience and within a reasonable period, normally no later than 30 days after notification. A longer period is allowed only for an objective reason beyond our control, which we must substantiate.
You may choose repair or replacement, unless the chosen remedy is impossible or disproportionate under the law. If the legal conditions are met, including an unremedied, repeated or sufficiently serious defect, you may seek an appropriate price reduction or withdraw. Withdrawal for a defect is unavailable where the defect is insignificant; we bear the burden of showing that. A unique artwork or exhausted edition may make an identical replacement impossible but does not remove other remedies.
Under Slovak consumer law, the liability period is extended by 12 months after the first repair of a defect, once only. We cover the statutory costs of taking back defective goods and reimburse justified costs of a valid claim. If liability is rejected, we provide written reasons. The complaints procedure is separate from the change-of-mind withdrawal right.
